Terms of Service
These Terms of Service (“Terms”) form a binding agreement between you and Worldwide Studios, a California 501(c)(3) nonprofit (“Worldwide Studios,” “we,” “our,” or “us”), and govern your use of the Philosophymaxxing mobile application and website (collectively, the “Service”). By creating an account or using the Service, you agree to these Terms.
1. Eligibility
You must be at least 13 years old to use the Service. If you are under the age of majority in your jurisdiction, you may only use the Service with the involvement of a parent or legal guardian.
2. Your Account
You are responsible for the information you provide and for the activity that occurs under your account. Keep your credentials confidential and notify us if you suspect unauthorized access.
3. License
Subject to your compliance with these Terms, we grant you a personal, non-exclusive, non-transferable, revocable, limited license to access and use the Service for non-commercial, personal use.
4. Acceptable Use
You agree not to:
- Use the Service for unlawful, harmful, harassing, defamatory, or fraudulent purposes;
- Attempt to reverse engineer, decompile, or extract source code, except as permitted by law;
- Interfere with the Service’s operation, security, or other users;
- Scrape, mass-download, or use automated systems to access the Service except as expressly permitted;
- Use the Service to generate content that violates intellectual property rights, privacy rights, or applicable law.
5. AI-Generated Content
Replies from philosopher tutors are generated by large language models. They may be inaccurate, incomplete, or out of date and should not be relied on as professional advice (legal, medical, financial, psychological, or otherwise). You are responsible for evaluating the accuracy and appropriateness of any output before acting on it.
6. User Content
You retain ownership of the content you submit. By submitting content to the Service, you grant us a worldwide, royalty-free license to host, store, reproduce, and process it solely as necessary to operate and improve the Service.
7. Subscriptions & Payments
Paid features may be offered as auto-renewing subscriptions through the Apple App Store. Payment is charged to your Apple ID at confirmation of purchase. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. You can manage and cancel subscriptions in your Apple ID account settings. Except where required by law, payments are non-refundable.
8. Apple-Specific Terms
The following applies to the iOS application:
- These Terms are between you and Worldwide Studios only, and not with Apple. Apple is not responsible for the app or its content.
- Your license is limited to use of the app on Apple-branded products that you own or control, as permitted by the App Store Terms of Use.
- Apple has no obligation to provide maintenance or support for the app.
- In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). Apple has no other warranty obligation whatsoever.
- Worldwide Studios — not Apple — is responsible for addressing claims relating to the app, including product liability, legal compliance, and intellectual property claims.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
9. Intellectual Property
The Service, including software, designs, text, graphics, and trademarks, is owned by Worldwide Studios or its licensors and is protected by applicable laws. Quotations from historical philosophers are in the public domain; their use in stylized form does not imply endorsement.
10. Termination
You may stop using the Service at any time and may delete your account from within the app. We may suspend or terminate your access if you violate these Terms or if continued provision is no longer commercially reasonable. Sections that by their nature should survive will survive termination.
11. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WORLDWIDE STUDIOS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA. OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) USD $50.
13. Indemnification
You agree to defend, indemnify, and hold harmless Worldwide Studios from and against claims and expenses arising from your use of the Service or violation of these Terms.
14. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict-of-laws principles. Disputes will be resolved exclusively in the state or federal courts located in San Francisco County, California, except where applicable law provides otherwise.
15. Changes
We may update these Terms from time to time. If changes are material, we will notify you. Continued use of the Service after changes take effect constitutes acceptance.
